EDUCATION – THE RIGHT OF EVERY CHILD Every child can learn. And handicapped children are, fi rst and foremost, children. Therefore, they are entitled to the benefi ts and rights the law gives children and local governments and school districts in Tennessee will make the same effort for handicapped children without handicaps. • Tennessee’s Mandatory Education of the Handicapped Act makes certain special provisions for handicapped children. • The State must provide free public education for each and every handicapped child age 3-21. • All local public education systems are to maintain a program to locate and identify at the earliest possible age all children who need services. • Parents must be involved in decisions concerning their handicapped children. • All Tennessee School Systems must evaluate the educational needs of their handicapped children at least once each year. • The starting point of education is different for each child. • The efforts taken to insure progress are different for each child. • School systems must design programs of public education services suffi cient to meet the needs of handicapped children. • School systems must work with parents to determine the needs of their handicapped children. • School must keep parents informed of their children’s progress. • Education should be provided in as normal a setting as possible, as close to home as possible. • Public school systems shall provide or secure the regular and special education that handicapped children require to benefi t from a free public education appropriate to their needs. • They must secure the informed consent of parents or guardians for all placement or changes of the placement of handicapped children. • Due process for handicapped children and their parents entitles them to the right to an impartial hearing, and the right to appeal decisions. THE SMITH COUNTY SCHOOL SYSTEM PROVIDES APPROPRIATE EDUCATION PROGRAMS FOR THE HANDICAPPED CHILDREN IN SMITH COUNTY. School System Seeks Out Children with Disabilities The Smith County School System is conducting a county-wide search for children with disabilities, age’s birth through twenty-one, who are not currently in school or enrolled in a program for the disabled but are in need of special education services. The school system provides special education services to disabled children, ages 3-21. (Those children in the public school program and those enrolled in Head Start have already been identifi ed.) The purpose is to locate and identify all disabled children and youth in Smith County so that they may receive an appropriate public education. Persons who know of a disabled child not receiving education services should contact Special Education Supervisor, Eric Swann, at 735-2187. Programs are available, and the support of all citizens and organizations is solicited in locating children with disabilities in Smith County. Smith County Schools is a recipient of additional IDEA-B ARRA funds and will be dispersed according to IDEA-B rules and regulations.
