PUBLIC NOTICE FIREWORKS 7-601. Sale of Fireworks. The regulations for the sale of fireworks within the municipal limits of the Town of Carthage shall be as follows: (1) It shall be unlawful to sell or offer for sale fireworks within the municipal limits of the Town of Carthage without a valid permit. The permit shall be obtained from the office of the Town Recorder, which shall be issued upon receipt of a completed application demonstrating that the applicant is qualifi ed to hold a permit for the sale of fireworks, and payment of the application fee. The application fee shall be $350.00. No person who has been convicted of violating the provisions of this Chapter within the twelve (12) months preceding the application, or who has not paid the application fee in full, shall be considered a qualified applicant. The permit shall be valid for a period of one (1) year. (2) It shall be unlawful to sell or offer for sale fi reworks within the municipal limits of the Town of Carthage other than within the fourteen (14) days prior to any occasion designated by this Chapter for the authorized discharge of fi reworks. (3) Unless otherwise authorized by the Town Council, fi rework sales to private citizens within the municipal limits of the Town of Carthage are limited to the following occasions: Independence Day (July 4) and New Year’s Eve (December 31). 7-602. Discharge of Fireworks. The regulations for the discharge of fi reworks within the municipal limits of the Town of Carthage shall be as follows: (1) It shall be unlawful to discharge fi reworks within the municipal limits of the Town of Carthage unless authorized by this Chapter. (2) Unless otherwise authorized by the Mayor, the occasions designated by this Chapter for the authorized discharge of fi reworks by private citizens are limited to the following: Independence Day (July 4) and New Year’s Eve (December 31). (3) Unless otherwise authorized or permitted by this Chapter, discharge of fi reworks by private citizens is permitted only on Independence Day and New Year’s Eve, and the days immediately before and after those holidays, from dusk until 10:00 p.m. on weekdays and 11:00 p.m. on weekends; except that in all cases, such discharge shall be permitted to continue until 12:30 a.m. on New Year’s Day (January 1). (4) Discharge of fi reworks by the Smith County Board of Education shall be permitted at Smith County High School during and immediately preceding or immediately following home football games. (5) Occasions designated by this Chapter for the authorized discharge of fi reworks by the Town of Carthage or other governmental entities may be established from time to time by resolution of the Town Council. 7-603. Enforcement. Violation of this Chapter shall constitute a misdemeanor punishable by a fine not to exceed $50.00 for each offense. Each unauthorized sale or discharge in violation of this Chapter shall constitute a separate offense. Fireworks used in the commission of an offense punishable under this Chapter are hereby declared to be an instrumentality of crime and public nuisance, and shall be subject to immediate forfeiture as contraband. The law enforcement officers employed by the Town of Carthage are hereby empowered to take possession of such contraband upon probable cause that an offense has been committed. Any person interfering with a law enforcement officer in the performance of his or her duty under this Chapter shall be guilty of a misdemeanor. Section 2.
