Section 401 of the Clean Water Act requires that an applicant obtain a water quality certifi cation from the state when a federal permit is required. This notice is intended to inform interested parties of this permit application and draft permit and rationale, and to ask for comments and information necessary to determine possible impacts to water quality. Up to 30 feet of Class A rip rap will be installed to prevent erosion. ANTIDEGRADATION In accordance with the Tennessee Antidegradation Statement (Rule 0400-40-03.06), the Division has made the preliminary determination that the proposed activities will not result in an appreciable permanent loss of resource values, and therefore will result in no more than de minimis degradation of waters with available parameters. For more information please reference Tennessee’s Antidegradation Statement which is found in Chapter 0400-40-03 of the Rules of the Tennessee Department of Environment and Conservation. FACTORS CONSIDERED In deciding whether to issue or deny this permit, the Division will consider all comments of record and the requirements of applicable federal and state laws. The division will consider the nature, scale and effects of proposed impacts. The Division will consider practicable alternatives to the alteration, loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impacts to unique, high quality, or impaired waters. In making this decision, a fi nal determination will be made evaluating appreciable permanent loss of resource values and proposed compensatory mitigation to ensure the project will not result in no overall net loss of state water resources values. NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS On or about June 8, 2021, the Town of Carthage will submit a request to the Tennessee Department of Economic and Community Development for the release of funds under the Appalachian Regional Commission, to undertake a project known as 2018 Carthage Water Pump Replacement for the purpose of replacing an existing water pump station with a new pump station and overall improve the system. Funding would come from the Appalachian Regional Commission (ARC) with up to $277,000.00 available for the project. A 50% match of funds spent would be supplied by the city. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on fi le at City Hall at 314 Spring Street and may be examined or copied during weekdays 8 a.m. – 4 p.m. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Mayo Sarah Marie Smith. All comments received by June 23, 2021 will be considered by the Town of Carthage prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The Town of Carthage certifi es to the Tennessee Department of Economic and Community Development that Sarah Marie Smith in her capacity as City Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfi ed. The Tennessee Department of Economic and Community Development’s approval of the certifi cation satisfi es its responsibilities under NEPA and related laws and authorities and allows the Town of Carthage to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Tennessee Department of Economic and Community Development will accept objections to its release of fund and the Town of Carthage certifi cation for a period of fi fteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certifi cation was not executed by the Certifying Offi cer of Town of Carthage (b) the Town of Carthage has omitted a step or failed to make a decision or fi nding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Tennessee Department of Economic and Community Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written fi nding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to The Tennessee Department of Economic and Community Development, Community and Rural Development, 312 Rosa L.
