INITIAL RESOLUTION AUTHORIZING THE ISSUANCE OF NOT TO EXCEED SIXTEEN MILLION AND NO/100 DOLLARS ($16,000,000) GENERAL OBLIGATION BONDS OF SMITH COUNTY, TENNESSEE WHEREAS, the Board of County Commissioners of Smith County, Tennessee (the “County”) has determined that it is necessary and advisable to borrow funds and incur indebtedness for certain public improvements as more fully set forth herein. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Smith County, Tennessee, that for the purpose of financing, in whole or in part, (i) the acquisition, construction, improvement, expansion and/or equipping of a garbage collection and disposal facility, including bridge and accessway construction to the facility (the “Projects”); (ii) payment of architectural, engineering, legal, fiscal and administrative costs incident to the Projects; (iii) reimbursement to the County for funds previously expended for any of the foregoing; (iv) payment of capitalized interest during construction of the Project and for up to six months thereafter; and (v) payment of costs incident to the issuance and sale of the bonds authorized herein; there shall be issued bonds, in one or more emissions, of said County in the aggregate principal amount of not to exceed $16,000,000, which shall bear interest at a rate or rates not to exceed six percent (6.00%) per annum, and which shall be payable from unlimited ad valorem taxes to be levied on all taxable property within the County. The Bonds shall be additionally payable from but not secured by the revenues to be derived from the operation of the County’s solid waste disposal system. BE IT FURTHER RESOLVED by the Board of County Commissioners of Smith County, Tennessee that the County Clerk be, and is, hereby directed and instructed to cause the foregoing initial resolution relative to the issuance of not to exceed $16,000,000 general obligation bonds to be published in full in a newspaper having a general circulation in the County, for one issue of said paper followed by the statutory notice: The foregoing resolution has been adopted.
